Anti-dumping duty in EU
The Union adopted a codified version of the regulation on the introduction of anti-dumping duty on import of goods from third countries.
REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (EU) 2016/1036 on protection against dumped imports from countries not members of the European Union
1. Anti-dumping duties may be imposed on any dumped product whose release for free circulation in the EU causes injury.
2. A product is considered as being dumped if its export price to the Union less than a comparable price for the like product in the ordinary course of trade, as established for the exporting country.
3. Exporting country is usually the country of origin. This may be an intermediate country, except where, for example, products across the country or just carry the products concerned are not produced in the country or in the country, there is no comparable price for them.
4. For the purposes of this Regulation, 'like product' means a product which is identical, ie alike in all respects to the product, or if there is no such product available with other products which, although not alike in all respects, has characteristics that are very similar to those of the product under consideration.
